I am a central Govt. retired pensioner aged 66 yrs.My wife aged + 60 yrs is suffering from Brain Tumor(Cancer) and undergoing chemotherapy treatment in Private cancer hospital . No medical reimbursement facility available to me.
Please clarify/tell me whether I will be eligible to claim deduction of Rs.60,000/- under section 80 DDB on account of expenditure actually incurred on the medical treatment of such disease or ailment as may be specified in the rules 11 DD.Due to receipt of revised pension arrears I am coming in income tax deduction zone as pension + arrears will be around Rs.3,39,000/-.

To claim deduction u/s 80DDB following condition should be satisfied.
(i) Neurological Diseases where the disability level has been certified to be of 40% and above,
On the Basic of facts given by you ,you are eligible to for deduction of Rs 40000 only.Enhanced Limit of 60000 is available if dependent /patient is senior citizen (attain age 65 in previous year ) not assesse who is is claiming the deduction.in your case your age is 66 ,However your wife's age is just 60 ,so you are eligible for only 40000 deduction or expenses incurred which ever is less.
Moreover the above said amount will be reduced by the amount reimbursed by employer/Insurance company .In your case this is nil.so you will get 40000 or expenses incurred ,which ever is less as deduction u/s 80DDB of the Income Tax Act.

To claim deduction u/s 80DDB following condition should be satisfied.

- Deduction is available to Individual or HUF only.
- Deduction is available on actual expenditure on medical treatment of specified Disease or ailment as prescribed.
- Expenditure should be incurred for medical treatment of
- assessee himself
- wholly/mainly dependent Husband/wife(spouse)
- wholly /mainly dependent children
- wholly/mainly dependent parents
- wholly/mainly dependent Brother
- wholly/mainly dependent Sisters
- in case of Huf ,wholly/mainly dependent member of the HUF
- Assesee shall have to submit certificate in form no 10-I from prescribed specialist working in Government hospital
- Government hospital includes a departmental dispensary whether full-time or part-time established and run by a Department of the Government for the medical attendance and treatment of a class or classes of Government servants and members of their families, a hospital maintained by a local authority and any other hospital with which arrangements have been made by the Government for the treatment of Government servants;
- This deduction can not be allowed by DDO(employer) while calculating the TDS amount .So assessee have to apply for claim this deduction while filing his return in Income tax tax department
- Deduction is available for Rs. 40000 or amount actually paid ,which ever is less.
- If expenditure has been done in respect of dependent who is at least of 65 year of age in any time during the previous year then deduction shall be Rs. 60000 or amount paid which ever is less. Update : Age Limit for Senior Citizen has been proposed to be reduced to 60 Year wef financial year 2012-13 through Finance Bill 2012

2. You can not claim deduction as you have not paid the exp.You can claim 40000/- only if you have paid the same .Further there is no benefit in claiming deduction in your account as your income is already less then taxable limit

DeleteYou can claim 80DDB @60000/- per year.Your employer can not consider this deduction while calculating tds so you have to apply for refund while filing income tax return . Further 10I form must be got prepared from Govt hospital or hospital as given above . You should ready this and keep it with you .not to be filed any where . present it if demanded by assessing officer

ReplyDeleteMy father was admited to a hospital as his premilinary diagnosis showed that he had anemia and latter he was transfered to another hospital because we got to know that he is having 100 % cash less mediclaim through his company (IOCL) in the second hospital and there it was found that he was suffering with colon cancer and he is still under going treatment in the second hospital.

1. calculate Total exp subject to maximum 40000/60000
2 subtract claim received from insurance company or employer from amount as per one.
In your case if amount reimbursed by insurance company is more than 40000/60000 then you will eligible for nothing.
However if this is not the case then you should get certificate form Govt hospital /dispensary or approved hospital to treat govt employee

Validity not provided under income tax act . It depend upon company's rule. As per govt office rule Bill must be submitted with in 6 Month.

The said form is required to be got completed and you should keep this in your income tax file but not required to be submitted to income tax department .Same is the case of medicine and other bills.

ReplyDeleteCan the form 10I be signed by the hospital where treatment is carried out ? My mother got treatment in HCG Bangalore institute of oncology and now i want to claim the tax benefit. Or do i need to goto gov hospital for getting form 10I ??

ReplyDeletemy mother is undergoing treatment for cancer since May 2012.i have got form 10i signed from govt doctor.I want to know whether I will need a fresh form 10i every year if I have to claim deduction under 80ddb in next years also.
