Due date extension applicable on compulsory e filing only ???!!!

Order under Section 119 of the Income Tax Act. 1961

On consideration of the reports of disturbance of general life caused due to failure of power and further in consideration of the fact that the e-filing of returns for a specified category of individuals and HUF has been made mandatory, the Central Board of Direct Taxes, in exercise of powers conferred under section 119 of the Income Tax Act, 1961, hereby extends the ‘due date’ of filing of returns of income for the Assessment Year 2012-13 to 31st August 2012 in respect of assessees who are liable to file such returns by 31st July 2012 as per provisions of section 139 of Income Tax Act, 1961.

Whether extension of Due date  is applicable for assessee who are required to compulsory e file their Income tax return ? 

There is general queries from reader whether this notification (extension) applicable on all type of assessees .The answer is yes , due date has been extended for all type of  person whether required to e file their return or not .


The answer is that due date has been extended only for compulsory e filing of returns  , as the word is used as "Such return" so it is clear now that date of extension is applicable on e filing of returns only .


CBDT has clarified in its press release that due date has been extended for all type of assesses and not only for the mandatory e filing case.

    Since the due date has extended. Do I need to get the new updated excel utility.?

    Otherwise the excel utility will include the interest also.?

    Please correct me.

    2. @RAJA BABU. As you said i tried with the old excel utility.

      I filled all the details and I selected the option 'Return filed under section as "11-Before Due Date"'.

      But still it calculates and adds 1% of the tax amount to be paid as interest.

      What should I do.? Please guide me.

  2. I guess, this order is applicable only for assessees who have to file their return electronically. For manual returns, the due date is already over (i.e. 31 July 2012)
