Ques:Banks are not giving challan tender date in case of payment by cheque but giving date of clearing of the cheque,Now if we have deposited the cheque before the due date but cheque cleared after due date what are the proof we have regarding challan tender date ?

Ans:I have collected the latest position of law regarding payment of taxes by cheque, you may read that also .regarding above question Though I am in the of the view that bank should give tender date on the challan But I think this is not an issue at all,why I think so please check it out

  • Though the bank has not giving proof to us challan tender date ,but the bank prepare multiple record regarding cheque receipt ,which can be called for if any penalty is leviable by any authority.so not to request bank officials to put tender date for every challan .I think no body has qualification regarding above that bank has multiple record regading check receipt date.
  • The new thing I would like to add that bank are also sending data of challan tender date and clearing date to Income tax deptt and it has been managed by NSDL for income tax deptt.and we can also check that from NSDL website any ways ....
  • when we check tan based view from Nsdl website after puting tan , we have the results under following column
No BSR Code Challan Tender Date Challan Serial No Received Date Major Head code Minor Head Code Nature of Payment Amount *

In the above columns Challan tender date has been clearly shown ,I think many have checked this but some has missed.Any how, if we have digital online record available with us than I think we should not waste time in argument with the Bank Staff .

The problem is solved as far as the matter related to TDS.

Now the advance tax, self assessment etc means tax deposited on PAN ,regarding this we can check the same by registering for pan login (form 26AS)
